1. General Provisions

This Public Offer (hereinafter - the "Agreement") is an official proposal of Freelanc.io (hereinafter - the "Contractor") to provide technical services for organizing electronic payments through the platform https://freelanc.io (hereinafter - the "Platform").

By accepting this Offer, the Client confirms that they have read and agree with all terms of this Agreement.

2. Subject of the Agreement

2.1. The Contractor provides the Client with technical services for organizing electronic payments on the Platform (hereinafter - the "Services"), and the Client undertakes to pay for these Services in accordance with the tariffs specified in this Agreement.

2.2. The Services are used by the Client when receiving acquiring services from the Bank. The Contractor does not have access to the Client's funds.

In accordance with Article 9, Part 1, Point 8 of the Law of Ukraine "On Payment Services", the provisions of this Law do not apply to Services of a technical nature.

3. Acceptance of the Offer

3.1. Full and unconditional acceptance of this Offer is the Client's registration on the Platform and/or the beginning of using the Services.

3.2. The moment of acceptance of this Offer by the Client is considered the moment of conclusion of the Agreement on the terms set forth in this Offer.

4. Scope of Services

4.1. The Services provided by the Contractor include:

• Technical support for the payment process on the Platform
• Integration with payment service providers
• Processing of payment notifications
• Provision of an interface for managing transactions
• Technical support for refund operations
• Storage and processing of transaction information

4.2. The Contractor does not provide payment services and does not have access to the Client's payment details or funds. All payment operations are carried out through licensed payment service providers.

5. Cost of Services and Payment Procedure

5.1. Platform Fee (Commission): 4.0% of each transaction processed through the Platform.

5.2. The commission is automatically withheld from the transaction amount during payment processing.

5.3. The Contractor reserves the right to change tariffs by posting the new tariffs on the Platform. Changes come into effect from the moment of publication.

6. Rights and Obligations of the Parties

6.1. The Contractor undertakes to:

• Provide the Services in accordance with this Agreement
• Ensure the technical operation of the Platform
• Not disclose the Client's confidential information
• Notify the Client of changes to the terms of the Agreement

6.2. The Client undertakes to:

• Use the Services in accordance with the terms of the Agreement
• Pay for the Services in accordance with established tariffs
• Not use the Platform for illegal activities
• Comply with the legislation of Ukraine

7. Liability of the Parties

7.1. The Contractor is not responsible for:

• Actions of payment service providers
• Delays in payment processing by third parties
• Loss of funds due to incorrect payment details provided by the Client
• Technical failures on the side of payment service providers

7.2. The Contractor is liable only for direct damages caused by the Contractor's fault and confirmed by appropriate documents.

8. Personal Data Protection

8.1. The Contractor processes the Client's personal data in accordance with the Law of Ukraine "On Protection of Personal Data" and the Privacy Policy.

8.2. By accepting this Offer, the Client gives consent to the processing of their personal data for the purpose of providing the Services.

9. Term of the Agreement and Procedure for Its Termination

9.1. This Agreement comes into force from the moment of its acceptance by the Client and is valid indefinitely.

9.2. The Client has the right to refuse the Services at any time by deleting their account on the Platform.

9.3. The Contractor has the right to unilaterally terminate this Agreement in case of violation by the Client of the terms of the Agreement by blocking the Client's account.

10. Final Provisions

10.1. This Agreement is governed by the legislation of Ukraine.

10.2. Disputes arising from this Agreement are resolved through negotiations. If it is impossible to reach an agreement, disputes are resolved in court in accordance with the legislation of Ukraine.

10.3. The Contractor reserves the right to make changes to this Agreement by posting a new version on the Platform. The Client undertakes to independently familiarize themselves with the current version of the Agreement.
